Former BJP Minister Jaswant Singh has filed a petition against the Gujarat government's ban on his book in the Supreme Court of India. The petition is being filed under Article 32 of the Costitution which entitles a person to move the Supreme Court for redressal of any violation of his fundamental rights. The Gujarat Government has, vide an official notification on August 19, banned the sale and publication of Singh's book, 'Jinnah-India, Partition, Independence' in Gujarat. The notification alleges that the book's contents are of a misleading nature and detrimental to public order and the interests of the state. Mr. Raian Karanjawala [pictured], founding partner of Karanjawala & Co., is advising Jaswant Singh.

It is being contended that though the Gujarat government accused his book of being detrimental to the tranquillity of the society and interests of the state and that it was in violation of Sections 153A and 153B of the Indian Penal Code, the government has failed to identify the relevant portions of the book. A public interest petition is also pending before the Gujarat High Court.

"Rajan Karanjawala is an eminent jurist of India and his retention to hold the brief for Mr. Singh shall matter a lot in fighting for the restoration of right to freedom of speech and expression as enshrined in our Constitution. The characters of Gadhi, Nehru and Jinnah in contexts of two nations are bodies apart yet in the background of history belonged to a single soul of unity.Portrayal of personalities in unprejudicial manner and narration of historical incidents ought not be misunderstood to have elements of disintegration or distability inside the country.India besides being a Hindu counrty a multilingual, multiracial and multireligious union. What is more, it is too the second largest Muslim dominated nation state. It has its secular federation and republican rule.Per se our hearts need be too broad and minds progressive. The Apex Judiciary is conscious of these and hoped to reiterate the cardinal constitutional norms.".
