The Executive Committee (EC) of the Supreme Court Bar Association (SCBA) has passed a resolution calling for a General Body Meeting of the SCBA on May 7 to discuss the non-elevation of Justice KM Joseph to Supreme Court..This step is pursuant to a request received by 181 SCBA members condemning the approach of the Executive in stalling the appointment of Justice Joseph..The resolution was passed yesterday and was attended by 19 EC members..Interestingly, the EC in its resolution has also set out another agenda for the General Body Meeting – removal of Vikas Singh from the post of SCBA President..The resolution states that the,.“EC expresses its No Confidence in the President and resolves to convene a General Body meeting for passing the following resolution:.Shri Vikas Singh, President may be removed from the office of President SCBA fortwith”.This agenda be also placed before General Body Meeting to be held on 7th May, 2018.” .The trigger for the resolution against its own President is that he gave incorrect message in the newsletter, ‘SCBA Times’ regarding the holding of SCBA Annual Day function..“The message of President in SCBA Times in the April 2018 issue was incorrect and contrary to the unanimous decision taken which was to ‘cancel the Annual Day Function’ and hence EC members recorded their strong objection to the same….It is felt that such unauthorised and factually incorrect statements by the President were published in the SCBA Times only because the EC does not have any control on the content to be published in the newsletter. “.The resolution also states that the President walked out of the EC meeting yesterday in order to avoid any explanation to the aforesaid charge..Meanwhile President Vikas Singh has already issue a clarificatory letter in advance with regard to the happenings of yesterday’s meeting..According to Singh, after discussing the issue pertaining to Justice Joseph, the EC members wanted to discuss the issue about discontinuing SCBA Times. The EC members also wanted to restrain him from addressing the Press which he rebutted by stating that he talked to press in his individual capacity and had never represented to the Press that what he was saying was the view of the SCBA..Singh then states that he adjourned the meeting since no fruitful discussion was taking place. But two more resolutions were passed in his absence – first for discontinuing SCBA Times and second for his removal from the Post of President..The provocation for the same, he has stated “appears to be my resisting their right to control my vision on issues concerning the judiciary and welfare of Bar members and my interaction with the Press.”.Read the EC Resolution and President Vikas Singh’s letter below.
