A man accused of stalking and rape has been granted protection by Delhi High Court on account of the harassment he faced from his accuser..By way of background, the man/petitioner was initially accused of stalking and harassing the complainant woman, in connection with which she filed a criminal complaint last April..Although he was allowed bail in respect of these offences, he was arrested again after the woman added a rape charge against him. A Saket court granted him regular bail in respect of this case as well last July. The petitioner has denied all charges made against him so far..However, in an odd twist to the tale, as submitted by the accused/petitioner before the Delhi High Court, he thereafter had to face incessant phone calls from the complainant/woman after being released on bail. As per his petition, filed through advocate Jayant Bhatt,.“… since the day of release of the Petitioner on bail Respondent No.4 has been incessantly calling the Petitioner at all hours during the day and night and has been trying to approach and contact the Petitioner.“.The petition goes on to furnish details of over 30 missed calls submitted to have been made by the complainant woman to the petitioner between April and October..This line of harassment also culminated in the woman approaching the petitioner’s landlord and former employer with threats to lodge fresh complaints against him if his whereabouts were not disclosed. The petitioner, therefore, moved the Delhi High Court for protection, submitting that,.“That the Petitioner is already undergoing a lot of mental and physical harassment at the behest of Respondent No.4 due to the false criminal proceedings instituted by Respondent No.4 against the Petitioner and her contacting the Petitioner over phone and in person is increasing the harassment caused to the Petitioner especially when he has been released on bail and is complying with all the conditions set forth by the Hon’ble Sessions Court.“.In view of the same, the Delhi High Court yesterday allowed this plea for protection and directed the police authorities to take appropriate measures to this end. The Court also directed the concerned Station House Officer to sensitise the complainant woman against approaching the petitioner and also ordered the appointment of a woman investigating officer as the alleged offence falls under Section 376 of IPC.
