Law Commission proposes amendment in Hindu Maintenance Act to provide maintenance for Hindu wives of incapacitated husbands

The Law Commission of India has released its 252nd report this month, recommending the amendment of Section 18 of the Hindu Adoptions and Maintenance Act, 1956 (Act). The proposed change comes as a response to the lacuna identified in the Act regarding situations where the husband is unable to maintain his wife by reason of physical disability or unsoundness of mind. The Punjab and Haryana High Court, in the case of Avatar Singh v. Jasbir Singh, decision dated February 11, 2014, had brought the same to the attention of the Law Commission.
