Marital Rape hearing: LIVE UPDATES from Delhi High Court

The Delhi High will continue hearing a batch of petitions demanding the criminalisation of marital rape.

The petitions challenge Exception 2 to Section 375 of the Indian Penal Code (IPC), which exempts non-consensual sex between husband and wife from the ambit of rape.

On 7 February, the Delhi High Court gave the Central government two weeks’ time to make its stand clear and come with a 'yes or no' answer on the issue of criminalisation of marital rape.

Assistant Solicitor General (ASG) Chetan Sharma was asked to make the Centre’s stand clear by today, after which the Court would take a decision as to how much time the government has to be given either to argue its case or to take a wider consultative view on the issue.

The matter is being heard by a Division Bench of the Delhi High Court comprising Justices Rajiv Shakdher and C Hari Shankar.
