The Madras High Court has, through a recent circular, notified that motor accident cases be disposed of within a time frame ..The circular states that such cases,.“…should be disposed of within a time frame, say within a period of 12 months from the date of numbering the petition. Once the matter is taken up for hearing, it shall not be adjourned beyond three working days at any point of time…”.The circular was issued pursuant to directions made in an order passed by the Court earlier this month. In the said order, it was observed that long pendency of such cases causes prejudice to the claimants, which is “certainly more painful than the injuries sustained by the claimant of the death of the deceased”..In the same order, it has also been directed that,.“the Insurance Company shall not be asked to pay compensation to the claimants through their nose as in many cases, interest alone runs to several lakhs on account of pendency of matters for years together before the Trial/High Court.”.The circular has been issued to all subordinate courts dealing with Motor Accident cases in Tamil Nadu and Puducherry..In a recent event, Chief Justice Indira Banerjee had hinted at the Court’s attempts to dispose of cases pending for more than five years by March 31 next year..Read Circular below..Click here to download the Bar & Bench Android App
