Supreme Court judge Justice Sanjay Kishan Kaul on Friday emphasised the need to find lawyers from diverse legal specialisation while choosing judges for High Courts across the country and the Supreme Court..The judge was addressing an audience at the 5th ICC India Arbitration Day at Hyatt Regency, Delhi when he said that very technical matters come up before the courts these days and such cases need to be heard by seasoned specialists. "Especially at the High Court level, when you pick up people as judges- it is important to spread your net wide. When I say, spread it wide, lets not confine judgeships to general practitioners," the judge said in this regard. .The nature of cases coming up before the Supreme Court, require constant training process and upgradation of skills, Justice Kaul opined. He explained that with some specialised tribunals coming up and their challenges being dealt by the court, it was time we spread the net to cover good lawyers across judicial areas who are willing to accept judgeship. "If we do that, we will get talent of specialist judges at least in High Courts and the Supreme Court. Though nobody would want to sit continuously on the same subject matter, the specialisation should be utilised for having particular kind of matters, dealt by particular judges.".Apart from this, the apex court judge also opined that economic empowerment and the methodology to deliver prompt justice are both interlinked. Therefore, he said that to grow economically and secure foreign direct investment, we must ensure that our arbitration system is modernised and made robust. "As economic empowerment grows, so does the anxiety to see that the courts provide an urgent remedy is looked into," Justice Kaul stated. .[Watch live-stream of the event below]
