SC Collegium recommends three names for elevation to Bombay and Madras HCs

The Supreme Court Collegium has recommended the names of three persons for elevation to Bombay and Madras High Courts. The resolutions dated April 19 have proposed one name for Bombay High Court, and two names for Madras High Court.

For appointment to the Bombay High Court, the Collegium has recommended Advocate Chetan S Kapadia. Kapadia’s candidature was deferred by the Collegium in October 2017 when it had requested the Chief Justice of Bombay High Court to furnish information relating to an intervention application filed by Kapadia. After receiving the requisite information by the end of October 2017, the Collegium has now made the recommendation.

For Madras High Court, two names have been recommended for elevation – advocate B Pugalendhi and judicial officer B Sarodjiny Devy. Both these proposals were deferred by the Collegium on December 4, 2017 and October 3, 2017 respectively.

Pugalendhi’s proposal came to be deferred on account of “certain adverse but unconfirmed inputs” received by the Collegium. The Chief Justice of Madras High Court, however, submitted his comments and report on the same via two letters submitted on February 20 and March 30 this year. Based on the said reports and after consultation with colleagues conversant with the affairs of the Madras High Court, the Collegium decided to recommend the name of Pugalendhi for Madras High Court judgeship.

As regards, Sarodjiny Devy’s proposal, the Collegium had deferred the same on account of a pending enquiry against her in the High Court. Subsequently, the Chief Justice of Madras High Court had submitted a report that no departmental enquiry is pending against Sarodjiny Devy. The Collegium, therefore, decided to go ahead with her candidature.
