When they protested, they were beaten by the 'batt' of 'tamancha' (pistol), 'balakati' and 'iron rod'..Consequently, the accused was booked for the offences of rioting, intentional insult with intent to provoke breach of peace, attempt to murder, assault or use of criminal force to woman with intent to disrobe, and voluntarily causing hurt..The accused submitted that no specific role was assigned to him by those injured, or the complainants and only a general role was assigned to the him. Additionally, it was submitted that he was not present on the spot at the time of the incident. It was also contended that this was a case of parity since the co-accused had already been granted bail by the High Court..The State opposed the prayer for bail, but they did dispute the applicant's contentions. .Therefore, the prayer for bail was granted subject to certain conditions in the interest of justice.
