Can MSME arbitration proceed if NCLT declares moratorium against one party? Bombay High Court to decide
The NCLT had initiated CIRP against petitioner-company pursuant to which the MSME council passed an award directing the company to pay an amount in an ongoing dispute. The same has been challenged before the High Court.
The Bombay High Court is set to examine a question of law with regard to statutory arbitration under the Micro, Small and Medium Enterprises Development Act (MSMEDA) for companies undergoing insolvency proceedings [Anuj Bajpai & Anr. v. Insteel Engineering Pvt. Ltd. & Anr.]
