BSV Prakash Kumar appointed acting President of NCLT Principal Bench

Judicial Member BSV Prakash Kumar has been appointed as Acting President of the National Company Law Tribunal (NCLT) Principal Bench at New Delhi. The interim appointment notified today follows the superannuation of Justice MM Kumar, former Chief Justice of the Jammu & Kashmir High Court.

Justice Kumar had been serving as President of the NCLT ever since its inception in June 2016.

BSV Prakash Kumar will serve as Acting President for a period of three months with effect from January 5, or until a regular President is appointed to man the NCLT Principal Bench.

He previously served as a Judicial Member at the Chennai Bench of the NCLT.

The notification issued by the Union Ministry of Corporate Affairs reads,

"Consequent on the completion of the term of Office of Justice Shri M.M. Kumar as President, National Company Law Tribunal (NCLT) on 04.01.2020, Shri Bethala Shantha Vijaya Prakash Kumar, Member (Judicial), the senior most Member in NCLT, shall act as President, NCLT in terms of Section 415 of the Companies Act, 2013 (18 of 2013) for a period of three months with effect from 05.01.2020 or until a regular President is appointed or until further orders, whichever is earliest."
