Lawyers submitting fake affidavits spoil the faith of Bar-friendly judges: Kerala High Court

"There have been so many cases where affidavits are filed and when later the prosecutor is asked to get instructions, it turns out they are fake," Justice Kauser Edappagath said.

Kerala High Court judge Justice Kauser Edappagath on Friday revealed in open court that there have been several instances of advocates filing fake affidavits.

The day of hearings was drawing to a close when the judge, who was hearing bail matters all day, was confronted with a case where the counsel representing the accused sought relief on the ground that a settlement had been reached with the complainant.

Justice Edappagath said that he cannot accept such submissions or affidavits on blind faith without giving the prosecution time to get instructions and verify its authenticity.

"There have been so many cases where affidavits are filed and when later the prosecutor is asked to get instructions, it turns out they are fake. Just ask the prosecutor," Justice Edappagath orally remarked.

The judge also questioned why lawyers seem to work under the impression that the court can grant bail or any other relief on a plea moved mere hours earlier, without giving a chance for the State prosecutor to get instructions on the matter.

"I will not accept any settlement until the prosecutor gets instructions. That is not going to happen. You file a petition at 1 PM and expect to get an order granting bail by 4 PM? They have to get instructions," he said.

As the final bell of the day rang at 4:00 PM, Justice Edappagath rose and rather dejectedly added,

"We are all working day and night, but still you (lawyers) are concerned about your one case only. You people will spoil a bar-friendly judge."
