The Supreme Court recently took exception to the Andhra Pradesh High Court listing a case in its causelist under the caption "For Dismissal" [K Ravi v. State of Andhra Pradesh].
A Bench of Justices Ujjal Bhuyan and Atul S Chandurkar found that although the High Court had heard the case, a criminal revision petition filed by a convict, on merits on November 21, 2025, it later listed the matter under the caption “For Dismissal” before ultimately dismissing it.
“Listing of a case under such a caption itself indicates that a decision has already been taken before actual pronouncement of the order. This is not proper, more particularly in criminal matters,” the Court said.
Therefore, the Court issued notice to the State of Andhra Pradesh on the plea filed by the petitioner-convict K Ravi for reconsideration or remand of the matter.
The case arose from an attack in Tirupati in October 2010, allegedly triggered by enmity relating to a Rajaka Sangham election. According to the prosecution, Ravi and four others formed an unlawful assembly and attacked two persons with knives.
In November 2011, a trial court convicted Ravi under Sections 147 (rioting), 148 (rioting while armed with a deadly weapon), 307 read with Section 149 (attempt to murder in prosecution of the common object of an unlawful assembly) and 324 read with Section 34 (voluntarily causing hurt with a dangerous weapon in furtherance of common intention) of the Indian Penal Code (IPC).
He was sentenced to five years simple imprisonment for the the offence of attempt to murder, besides shorter sentences for the other offences. All the sentences were directed to run concurrently.
A sessions court upheld his conviction and sentence in October 2015, prompting him to move the Andhra Pradesh High Court in revision.
The High Court heard the matter in November 2025.
When the matter was listed for judgment on December 4, the causelist said "for dismissal".
The High Court then proceeded to dismissed the revision after finding no illegality or impropriety in the concurrent findings of the courts below. It also revoked the suspension of Ravi’s sentence and directed him to surrender within three weeks.
Ravi then approached the Supreme Court against the High Court ruling.
The top court has now issued notice on his plea and listed the matter for further hearing on October 29.
