In search of judicial dialogue: Vanishing deliberation in Constitution Bench judgments
For a larger bench to be fully effective in ensuring finality, adequate intra-bench dialogue is crucial to ensure logically-reasoned conclusions.
In November 2024, Justice DY Chandrachud penned one of his last judgments as Chief Justice of India for the majority in the seven-judge Constitution Bench in Aligarh Muslim University v. Naresh Agarwal and Ors. At first glance, the AMU case seems to be an instance of Constitution Benches fulfilling their purpose - a large number of judges debating and delivering their verdicts.
