Lately, a series of webinars have been conducted on important legal questions surrounding the field of dispute resolution.
Compiled below is a collection of discussions featuring eminent lawyers as well as sitting and former judges of the Supreme Court and High Courts on various aspects of arbitration and other dispute resolution mechanisms.
Some of the topics covered in these webinars include Enforcement of Foreign Arbitral Awards: Recent Developments; Appointment of Arbitrators; Funding Infrastructure Disputes: Using Litigation Finance as a Strategic Tool; and Fundamentals of Examination-in-Chief and Cross Examination in a Civil Suit
The webinar was conducted on April 23, 2020. It was hosted by FTI Consulting in collaboration with Arbitration India Group, Indian Arbitration Forum, Centre for Excellence on Alternate Dispute Resolution, - Faculty of Law at Manav Rachna University, and Society of Construction Law-Young Leaders Group.
The key speakers for the webinar were Justice Prateek Jalan of the Delhi High Court and Senior Advocate Gourab Banerji. The webinar was moderated by Shashank Garg, Partner at Advani & Co, and Omar Ahmed, Partner at Cyril Amarchand Mangaldas.
The webinar involved a detailed discussion on several case laws contributing to the jurisprudence of Section 44 of the Arbitration & Conciliation Act, 1996, which covers the scheme for enforcement of foreign awards in India. The panel also analysed the grounds under which the court can refuse enforcement of foreign awards, as per Section 48 of the Act.

The webinar saw a detailed discussion on the provisions of Indian Contract Act that deal with damages and the relevant case laws on the subject.

The panel discussed a plethora of cases regarding the scope of interference by the court when an award is challenged under Section 34.

The two-hour session explored in depth third-party litigation finance from its legal, economic and commercial perspectives.

The distinguished speakers for the event included Justice Jyoti Singh of the Delhi High Court and Senior Advocate Parag Tripathi. The event was moderated by Dr Shashwat Bajpai (founder of DRSB Law chambers) and Aakansha Kaul, Advocate, Delhi High Court.
The webinar saw a discussion on various aspects of a Section 9 application including scope of the supervisory court’s power to grant relief and the circumstances in which such relief may be granted.
