CCI clears ALSTOM merger in record 7 days Amarchand represents ALSTOM

Amarchand Mangaldas has represented ALSTOM Holdings India Ltd (AHIL) and ALSTOM Projects India Limited (APIL) in obtaining merger control clearance from the Competition Commission of India (CCI) in relation to the proposed combination wherein AHIL will merge into APIL pursuant to implementation of scheme of amalgamation.

Amarchand filed a joint notice before CCI on October 12, 2011 and obtained a clearance from CCI within 7 days of filing its application.

The CCI in its 3 page order has said “It is observed that both AHIL and APIL are engaged in different business activities. It is also observed that both AHIL and APIL are part of the ALSTOM group of companies, the ultimate holding of which is with ALSTOM Holdings. Further, the amalgamated company APIL would continue to be under the same management subsequent to the implementation of the scheme of amalgamation approved by the Board of Directors of both AHIL and APIL. Given the foregoing, the proposed combination is not likely to have an appreciable adverse effect on competition in India”.

Amarchand Delhi competition law team led by Director Paku Khan along with Shweta Shroff Chopra, Harman Sandhu and Sangeetha Mugunthan represented ALSTOM before the CCI.
