The Supreme Court on Wednesday granted bail to an accused in the 2013 Sabarmati Jail break case taking into account the fact trial had not commenced in the case for 11 years during which the accused remained in jail [Raziuddin Nashar vs State of Gujarat]..The bench of Justices CT Ravikumar and Rajesh Bindal granted bail to the accused today after being informed that though he was acquitted in a related case, he continued to remain in prison since there was no progress in trial in the jailbreak case. .The accused Raziuddin Nashar has been in jail since 2008 in connection with the 2008 Ahmedabad Blasts. However while he was in jail, he was also roped in as an accused in the jailbreak case in 2013.He was later acquitted of all the offences in the Ahmedabad blasts case by a special court in February 2022. .In the jailbreak case, the top court was informed that the prosecution has cited 169 witnesses and that the conclusion of the trial which has not even commenced in 10 years cannot foreseeably conclude in any reasonable time frame..Senior Advocate Dr. S Muralidhar assisted by advocates Shariq Nisar and Anas Tanwir appeared for the petitioner.
