In a big relief to builders and developers, the Supreme Court today allowed construction activity to be started in Delhi NCR between 6 AM and 6 PM..The Special Bench of Justices Arun Mishra and Deepak Gupta today lifted the ban on construction activities partially in order to contain pollution levels. The Court had imposed a moratorium on all construction and demolition activities in light of the acute problem of air pollution that had engulfed the Delhi NCR region as well as its adjoining areas..In the previous hearing, the Apex Court had also directed the States of Punjab, Haryana, and Uttar Pradesh to form a high-level committee to look into the problem of air pollution that was making Delhi “worse than narak” to live in..Assistant Solicitor General Atmaram Nadkarni told the Court today that the high-level committee had been formed and had met in compliance with the Apex Court’s orders and has examined the issue of feasibility of installing smog towers..In the previous hearing, the Court had directed not only for the high-level committee to be set up but also for the Delhi government to inform the Court of the steps taken by it to mitigate the air pollution problem. The Court had also posed a question before States and Union Territories as to why no tortious liability should be imposed on them for failing to provide clean air and water to the citizens..The Court will now hear the matter concerning Air pollution next on December 16..[Read Order]
