Allahabad High Court finds judge incompetent in judgment writing, orders three-month training

The Allahabad High Court recently directed that an Additional District Judge (ADJ) be sent to the Judicial Training and Research Institute at Lucknow for a three-month training in judgment writing. .Justice Neeraj Tiwari passed the order after finding that ADJ Dr Amit Verma in at least two cases had passed unreasoned orders. "From perusal of the order of this Court dated 17.12.2024 as well as impugned order dated 1.3.2025, this Court is of the firm view that Dr. Amit Verma, Additional District Judge, Kanpur Nagar is not competent to write the judgment, therefore, he must be sent for training at least for three months in Judicial Training and Research Institute, Lucknow," the Court said..The Court directed the Registrar General of Allahabd High Court to place the matter before the Chief Justice and obtain necessary orders to send ADJ Verma on training. The direction was passed on a petition challenging an order passed by ADJ Verma in a landlord-tenant dispute case.The petitioner Munni Devi before the district court had filed an application to add new grounds to her case pending there. However, the application was rejected by ADJ Verma through a brief order, leading to the present challenge..Her counsel argued before the Court that not a single line was written by the district judge to explain why the amendment application was rejected.He also pointed out that ADJ Verma had committed a similar mistake last year and that order was subsequently set aside."Again Dr. Amit Verma, Additional District Judge, Kanpur Nagar has committed same mistake and impugned order has been passed without recording any finding, therefore, same is bad and liable to be set aside," the counsel submitted. .After reading ADJ Verma's order in the present case, the Court noted that it contains seven paragraphs and the operative portion. "In all 7 paragraphs only facts and argument of both the parties have been recorded and without recording any finding straight away learned judge has rejected the application by three-line order," it added. Thus, the Court agreed with the petitioner's submission that ADJ Verma had repeated the same error he had made in a previous case last year. The Court, therefore, went on to quash the order under challenge with a direction to the competent court to decide the matter afresh.
