SUPREME COURT OF INDIA

  • Bhartiya Janata Party west Bengal vs The State of West Bengal & Ors

Item no. 4 in Court 1 – SLP (c) No. 33893/2018

Bench- CJI Ranjan Gogoi and Sanjay Kisha Kaul J.

This petition is filed against the decision of the Division Bench of the Calcutta High Court which disallowed the BJP to carry out a Rath Yatra in the State of West Bengal.

Today in Court: The Supreme COurt issued notice in the case today.

  • Alok Kumar Verma vs Union of India & Ors (For Judgment)

Item no. 1501 in Court 1 – WP (C) No. 1309/2018

Bench- CJI Ranjan Gogoi with Sanjay Kishan Kaul and KM Joseph JJ.

The three-Judge Bench will deliver its judgment in the petition filed by the Director of the CBI, Alok Verma challenging the Centre’s decision to divest him of his powers and send him on a leave.

Today in Court: The Court set aside the Centre’s order that divested Alok Verma of his powers as the Diorector of the CBI, thereby reinstating him with a rider that Verma must cease and desist from taking any major policy decision.

  • Progressive Lawyers Association Civil Court & Anr vs High Court of Judicature at Allahabad & Anr

Item no. 2 in Court 2 – SLP (C) No. 35711/2017

Bench- AK Sikri, S Abdul Nazeer, and MR Shah JJ.

This petition highlights the allegations of corruption against a recently sworn in Additional Judge of the Allahabad High Court, Justice RK Gautam. In the previous hearing, the Court had asked the lawyer for the petitioners to compile and collate a list of all the allegations against Gautam J.

Today in Court: The Supreme Court adjourned the matter today after a brief hearing.

  • Sonia Gandhi vs Assistant Commissioner of Income Tax & Ors

Item no. 7 in Court 2- SLP (C) No. 28627/2018

Bench- AK Sikri, S Abdul Nazeer, and MR Shah JJ.

The matter pertains to the reassessment of the IT returns of Sonia Gandhi, Rahul Gandhi, and Oscar Fernandes in relation to the National Herald transaction for the year 2011-12. During the previous hearing the Court had given a green signal to the IT Department to reopen the assessment and complete it but without giving effect to the same.

Today in Court: The petitioners have sought time to file a contentious CBDT circular and its withdrawal on affidavit. The Court granted time to petitioners for the same and granted time to the Centre to file its counter to the same. The next date of hearing in the case is January 29.

  • Monsanto Technology LLC  vs Nuziveedu Seeds LLC thru the Director & Ors (For Judgment)

Item no. 1501 in Court 6- CA No. 4616-4617/2018

Bench- Rohinton Nariman and Navin Sinha JJ.

This appeal is against the decision of the Delhi High Court that had held that Monsanto’s patent claim on Bt cotton seed variety is unenforceable in India.

Today in Court: The Court set aside the decision of the Division Bench of the Delhi High Court while remanding tyhe case to the Single Bench to adjudicate on the question of patent infringement of Bt cotton seeds.

DELHI HIGH COURT

  • UOI vs Vodafone Group Plc & Anr

Item no. 24 in Court 38- RFA(OS) 38/2018 

Bench- GS Sistani and Jyoti Singh, JJ

This case pertains to Centre’s appeal against the dismissal of its petition seeking an injunction against Vodafone from initiating arbitration proceedings in the UK under the India-UK Bilateral Investment Protection Agreement.

Today in Court: This case could not be tracked.

  • Dr. Zaheer Ahmed vs UOI & Ors

Item no. 8 in Court 1-  W.P.(C) 11711/2018 

Bench- Chief Justice Rajendra Menon, Justice V Kameswar Rao

This is plea seeking directions to Central government and the Delhi government to restrain the online sale of medicines by e-pharmacies.

Today in Court: The Delhi High Court extended the stay on sale of medicines online through e-pharmacies till February 6.

MADRAS HIGH COURT

  • Traffic Dr KR Ramaswamy vs The Chief Secretary and others

Item no. 4 in Court 4 – WP 16307/2017

Bench – M Sathyanarayanan and P Rajamanickam JJ.

This batch of PILs moved by social activist Traffic Ramaswamy pertains to the erection of illegal banners and hoardings in the state of Tamil Nadu. When the matter was taken up last in December 2018, the Bench had passed a sternly worded order barring political parties from erecting any such banners throughout the state.
