  • Grace Banu Ganesan v State of Tamil Nadu

Bench: Justices S Manikumar and Subramonium Prasad

PIL petition moved by transgender activist Grace Banu Ganesan calling for horizontal reservation for transgender persons in public employment and educational institutions. The High Court had issued notice in the matter earlier this month.

These petitions were filed in view of April 18 being set for voting in Lok Sabha elections in Tamil Nadu. This polling date coincides with the Chithrai Festival held in Madurai. In view of the same, it is prayed that the election be rescheduled. The election also falls on the same date on which Christians will be observing Maundy Thursday this year. Therefore, it is prayed that the election date either be changed or that the Election Commission undertake to ensure that access to prayers being conducted on the said day is not disrupted where the polling venue is located within church premises.

Appearing for the Election Commission yesterday, standing counsel Niranjan Rajaopalan told the High Court yesterday that it would not be possible to reschedule the elections. However, he informed that the Commission will provide facilities to ensure that access to prayers would not be disrupted.
