BBMP, BDA and KIADB are very bad litigants: Karnataka High Court

We feel sorry. I was speaking to the honourable Chief Justice about the attitude of BBMP. We have problem with BBMP, BDA and KIADB. They are very bad litigants, to say the least," Justice Dixit said..The Court was hearing a suo motu public interest litigation (PIL) regarding the ineffective implementation of the Right of Children to Free and Compulsory Education Act, 2009 and the Karnataka Right to Free and Compulsory Education Rules, which resulted in large numbers of children being out of school..Amicus curiae in the case, Senior Advocate KN Phanindra informed the Court that the report submitted by the State government indicated that 123 schools had only one toilet.He emphasized that according to the RTE Act, there should be separate toilets for boys and girls. Despite this, the government report stated that 69 schools had issues related to toilets.He further pointed out to the bench that BBMP had not submitted a report on BBMP schools, as directed by the High Court in October 2023..Advocate NK Ramesh, representing the BBMP, said that the status report of the BBMP schools in respect of eight zones would be submitted within a week. Unsatisfied, the Bench remarked that BBMP, BDA and KIADB were bad litigants.Thereafter, Advocate Nilofar Akbar for the State government said that an affidavit will be submitted regarding problems in the schools.Ultimately, the Bench sought an action taken report from the State government and the BBMP, and listed the matter for hearing on March 27.
