BJP IT Cell Head Amit Malviya slapped with a one crore defamation notice by two Shaheen Bagh protesters

In an interesting turn of events, two women who had recently participated at the Shaheen Bagh protest against the controversial Citizenship (Amendment) Act, 2019 has served a legal notice for defamation to Amit Malviya, the head of IT Cell of Bharatiya Janata Party (BJP)..The legal notice states that Amit Malviya, being a member of the BJP has a "vested interest in defaming the mass of protesters". The notice further states that Malviya has tried to attack the integrity of protesters in order to turn away the eyes of the media and the public from the actual truth. .The main allegation against Malviya was that he had circulated a video in twitter and other social media platforms alleging that the protesters are taking money to be a part of the protests. In this regard, the legal notice reads, .A video posted and endorsed by you on social media site Twitter, which has been played across several media platforms, had alleged that the protesters are taking five hundred to seven hundred rupees in order to be a part of the protests. Such statements are not only false but also have an effect of defaming the protesters in the national and international community.Legal Notice served to Malviya.The notice further points out that the Shaheen Bagh protesters have carved out a unique identity for themselves owing to the involvement of women and also, the peaceful nature of the protest in itself. Therefore, slamming such baseless allegations and remarks with an intent to defame them has had a maligning effect on the good reputation of the protesters as individuals and as a part of the protesters' group..The legal notice sent further reads as follows,.By making and propagating false allegations against the protesters and casting aspersions on their motivations, you, the addressee, and other entities, have not only played a fraud on the general public but have also attempted to bring disrepute to the protesters who are bringing the attention of a large number of people on the issues being pressed by this extraordinary exercise of Constitutional freedom.Legal Notice served to Malviya."As you have no legal means to remove the protesters, nor any moral capital to counter their contentions, you are now resorting to public misinformation to save the face", the notice further states. The notice also asserts that these unwarranted acts on the part of the BJP leader has completely misled the public and has provided an open opportunity for other entities for engaging in such exercises of spreading false information..In this regard, the legal notice issued by Advocate Mehmood Pracha has stated that Malviya's actions constitute an offence under Section 500 of the Indian Penal Code, 1860 (Defamation) and further has demanded Malviya to pay up a whopping sum of one crore for defaming his clients..[Read the legal notice here]
