[BREAKING] Bombay High Court allows Aryan Khan plea for modification of bail condition; NCB does not oppose

The Bombay High Court, on Wednesday, allowed the plea filed by Aryan Khan, son of Bollywood actor Shahrukh Khan seeking modification of the bail conditions in the cruise ship drug case. .Single-judge Justice Nitin Sambre exempted Khan from appearing before Narcotics Control Bureau (NCB) Mumbai office every Friday, which was one of the bail conditions laid down while granting bail to Khan. Pertinently, the Narcotics Control Bureau (NCB) did not oppose the plea but submitted that the relaxation should be allowed subject to the condition that Khan should appear before the Special Investigation Team (SIT) probing the case in Delhi as and when he is summoned."The counsel for NCB places on record reply, and he states that whatever is the modification can be granted in light of para 7 (of NCB reply). Sufficient notice is given. With aforesaid background, condition (i) and (j) stands modified. The applicant shall attend office at Delhi as and when summoned with a 72 hour prior notice," the Court recorded in its order while allowing the plea.The applicant (Aryan Khan) will be summoned as and when his presence is required by SIT for the purpose of investigation either in Delhi or Mumbai, the Court recorded from NCB reply. .Khan had moved the High Court seeking modification of the bail conditions granted by Justice Nitin Sambre.The High Court had on October 28, 2021 allowed the bail plea filed by Khan and co-accused Arbaaz Merchant and Munmun Dhamecha in the cruise ship drug case.The next day, the High Court had released a bail order setting out 13 conditions to be fulfilled by the three accused.One of the conditions was to attend office of Narcotics Control Bureau (NCB), Mumbai every Friday between 11 am and 2 pm to mark his presence.Khan by way of the present plea, sought modification of that order on the following grounds:that since the investigation has been transferred to the Special Investigation Team, Delhi office of NCB, his visits to the Mumbai office could be relaxed.that every Friday when he visits the NCB office in Mumbai, he is accosted by the policemen due to the large presence of media personnel outside the office..Ten grounds on which Aryan Khan has sought exemption from appearance before NCB Mumbai
