Justice SS Shinde of Bombay High Court has recused himself from hearing petitions arising from the Bhima Koregaon riots which took place in 2018 after the Elgar Parishad event..Justice Shinde will be releasing a circular/notification to that effect shortly, sources have told Bar and Bench.After such circular/notification is issued, the respective lawyers representing the 15 accused in the case, will have to move the Chief Justice of the High Court on administrative side to get a new Bench constituted for hearing the petitions arising from the 2018 case. .The Bench led by Justice Shinde has been hearing writ petitions pertaining to the Bhima Koregaon incident since 2020, till end of 2021 when the assignment for writ petitions was transferred to another Bench led by Justice Nitin Jamdar, followed by Justice PB Varale.Justice Varale however, recused from hearing the matters pertaining to the case in the previous month. After this, the matters were sent to an alternate Bench which was headed by Justice Shinde. .Sources said that Justice Shinde will continue hearing the plea filed by three accused in the case seeking review of the judgment refusing them default bail as the order was passed his bench. Apart from this one case, he has recused from every other petition arising from the 2018 case. .It was Justice Shinde-led Bench which had pronounced two major orders in the case granting bail to two accused - Telugu poet Varavara Rao and lawyer and activist Sudha Bharadwaj. His bench was also hearing bail appeals filed by another accused Stan Swamy when Swamy passed away in judicial custody.Justice Shinde had then made some remarks lauding Swamy's social service. The NIA counsel had objected to the same prompting the judge to take it back. This is a developing story.
