Calcutta High Court stays arrest warrant against TMC MP Mahua Moitra

The Calcutta High Court on Tuesday stayed an arrest warrant issued against Trinamool Congress MP Mahua Moitra by a trial court in a case of alleged hate speech [Mahua Moitra v State of West Bengal and Others]

A Bench of Justice Debangsu Basak and Justice Aryak Dutt passed the order on Moitra’s petition seeking quashing of the complaint case filed against her before a Krishnanagar court

“Till September 30, 2026 or until further orders, police will not execute warrant of arrest issued as against the petitioner on August 19, 2026,” the Court directed.

A Krishnanagar court had issued an arrest warrant against Moitra on August 19 after she failed to appear before it. Today, the High Court said that the issue with regard to the jurisdiction of the court which directed issuance of arrest warrant against her requires consideration.

Moitra’s counsel earlier submitted that due to a resolution of the local bar association, she could not participate in the complaint case on June 18. It was also argued that the complaint case was pending before a court lacking jurisdiction to hear it.

The complaint case against Moitra reportedly accuses her of making objectionable remarks, including those insulting women.

Advocates Debasish Roy, Arka Kumar Nag, Soham De Dhara,  Suvam Das and Akash Ghosh represented Moitra.

Public Prosecutor Kallol Mondal with Advocates Pawan Gupta and Anamitra Banerjee represented the State.
