“Disconcerting, unfair”, Chandrachud J. dissents again, berates Police conduct in Bhima Koregaon

Supreme Court judge, Justice DY Chandrachud has penned another strongly worded dissenting opinion, the second this week..In the Bhima Koregaon case, Chandrachud J. today berated the Maharashtra police for what he termed as using electronic media selectively for shaping public opinion..In the petition seeking SIT, the judge dissented from the majority opinion penned by CJI Dipak Misra and AM Khanwilkar..On the issue of maintainability, Chandrachud J. opined that technicalities cannot be allowed to override substantive justice..He held that the present petition was not motivated by political aspects before proceeding to criticise the conduct of Pune police in the case..Referring to the press conference held by Pune Police immediately after the interim order passed by Supreme Court, Chandrachud J. said that it was an attempt to selectively leak information and termed it “disconcerting”..He added that the use of electronic media and police briefing by media has become a way of shaping public opinion..Also referring to the letter allegedly written by Sudha Bhardwaj, Chandrachud J. noted that it was flashed on a TV channel and selective disclosure of probe details cast cloud on the fairness of the investigation..He went so far as to raise doubt on whether Maharashtra police can carry out the investigation in a fair manner..The judge concluded by ordering an SIT probe while stating that voices of opposition cannot be muzzled because it is unpopular..Earlier this week, Justice Chandrachud had dissented in Aadhaar case striking down the Aadhaar Act and Aadhaar project as unconstitutional..Read the judgment by Justice DY Chandrachud.
