Collegium’s decision to transfer Justice Jayant Patel was unanimous, taken after considering inputs-on-record

In a significant development, highly placed sources have confirmed to Bar & Bench that the decision to transfer Justice Jayant Patel was a unanimous one by the Supreme Court Collegium.

According to sources, the Collegium headed by Chief Justice Dipak Misra had taken the decision conscientiously after considering inputs on-record pertaining to Justice Patel.

Justice Jayant Patel, who was a judge of the Karnataka High Court, was set to take over as the Chief Justice of the High Court when the Collegium decided to transfer him to Allahabad.

Justice Patel had then resigned from office leading to outrage at the Bar in Gujarat and Karnataka High Courts.

The Gujarat High Court Advocates Association is also planning to file a petition in the Supreme Court seeking greater transparency in Collegium proceedings even as the Collegium itself is mooting a procedure to guide it for selection of judges to higher judiciary.
