
A Delhi court on Tuesday remanded an Investigating Officer (IO) to judicial custody after he failed to pay ₹10,000 as the amount of bailable warrant despite leaving the courtroom to get the same from an ATM.
Special Judge (POCSO Act) Ramesh Kumar earlier in the day had issued non-bailable warrant (NBW) against the IO Sandeep Rawal after he failed to appear before the Court in a criminal trial despite service of a bailable warrant.
Later, Rawal told the Court that he had gone to Saket Court to file a supplementary charge-sheet in another case and thus made a request for cancellation of the NBW.
However, the special judge at Karkardooma Courts observed that Rawal's conduct showed that he did not have regard for the process of court and agreed to cancel NBW only against a payment of ₹10,000.
Rawal agreed to pay the same and left the court to take the money from the ATM. However, when the matter was called again, he submitted that he is not ready to pay the amount.
Accordingly, the Court directed that he be taken into custody.
"Since despite taking time from the court to pay the amount of Bailable Warrant, applicant/IO has not paid the amount of bailable warrant. He wasted the precious time of the court. Hence, applicant/IO be taken into custody and be sent to JC," the special judge ordered.
