As per the report, Justice Narayan Shukla had written to the CJI Gogoi requesting that he be allowed to resume his judicial work which was withdrawn from him in January 2018. Justice Gogoi, however, turned down the request and has now asked the PM to initiate motion in Parliament for removal of Justice Shukla.
Charges of judicial impropriety were slapped against Justice Narayan Shukla after it was found that he had made handwritten corrections to an order passed by his own bench, so as to allow a medical college in Lucknow permission to take admissions.
An in-house committee comprising Indira Banerjee, SK Agnihotri and PK Jaiswal was constituted to probe into the charges. The committee conducted an inquiry and subsequently submitted its report to former CJI Dipak Misra.
The committee, in its report, made some adverse remarks against Shukla J in its report, after it was found that he had made handwritten corrections to an order passed by his own bench, so as to allow a medical college in Lucknow permission to take admissions. According to news reports, Shukla had made corrections to an order passed on September 1, 2017 three days later, thereby allowing GCRG Institute of Medical Science to admit fresh students for the academic session 2017-18.
Further, it was alleged that Shukla J had violated orders passed by the CJI Misra-led bench of the Supreme Court, which was hearing cases regarding opening of medical colleges.
Following the panel’s indictment, CJI Misra had reportedly advised Justice Shukla to either resign or take voluntary retirement. However, after the High Court judge had refused either, CJI Misra had reportedly asked Allahabad High Court Chief Justice DB Bhosale to withdraw judicial work from the judge. This was in January 2018. Pursuant to that, Justice Shukla had gone on leave.
