How will investors have confidence in India if lawyers keep striking? Supreme Court

The Supreme Court on Monday implored lawyers to desist from resorting to strikes so as not to spook investors interested in an emerging economy like India [Faizabad Bar Association v. Bar Council of Uttar Pradesh and Others]..A Bench of Justices Surya Kant and Ujjal Bhuyan made it clear that everyone in the legal profession has a serious duty in this regard."We are also for effective mechanism to address their (lawyers) grievances but system must not stop even for an hour. I said recently too, we have such an emerging economy but with these (strikes) how will investors have confidence? There is onerous responsibility on all. Think about common man in this country. We must have something to stop (strike) culture," Justice Kant remarked..The Supreme Court was hearing the Faizabad bar association's appeal against an August 8 decision of the Allahabad High Court that established an Elders Committee to take over the affairs of the association including elections to its Governing Council to be held by December.In September, the top court had called for the submission of data on the number of lawyers' strikes and boycotts by district bar associations that have taken place in Uttar Pradesh this year. Earlier, it had also expressed strong disapproval over the frequent lawyers' strikes called for by the bar body, and proceeded to order every office bearer of the bar association to file an affidavit stating that they would not pass any resolution to abstain from judicial work in future. .During today's hearing, the Bench ordered that the High Court's report on strikes in the State be placed on record and shared with counsel.The Faizabad bar's matter was adjourned till December 20. "Have patience that is all. We appreciate you are releasing your mistake," the Court told the counsel representing the bar body today..Senior Advocates Rakesh Kumar Khanna and Sukumar Pattjoshi with Advocates Kumar Murlidhar, Atul Verma, Aditya P Khanna, Adarsh Kumar Pandey, Mukesh Kumar, Varun Chugh, Mithilesh Kumar Jaiswal, Arun Kanwa, Vignesh Singh, Anoop Krishna Upadhyay, Abhinav Kaushik, Prashant Trivedi, Alok Kumar, Gautam Barnwal, Shailendra P Singh and Rohit Singh Lodhi appeared for the Faizabad bar association.Senior Advocate CU Singh appeared for the original writ petitioners before the High Court, who are opposing the bar body's appeal before the Supreme Court.Senior Advocate and Uttar Pradesh Additional Advocate General K Parameshwar appeared for the Allahabad High Court.
