Justice Jasti Chelameswar recuses (after 2 years) in Bangalore blasts accused case

In a surprising development, Supreme Court’s Justice Jasti Chelameswar has recused from hearing the case pertaining to Bangalore blasts accused, Abdul Nazir Maudany.

The order (see below for full text) delivered after the hearing on March 8 does not given any reason for recusal but states as under:

“List next week before a Bench of which one of us (Hon’ble Mr. Justice J. Chelameswar) is not a member.”

What is interesting is that on that particular day, the judge had simply adjourned the matter for next week and had not said that he would be recusing. The judge’s recusal only came to light after the order was published on the Supreme Court website.

Justice Chelameswar has been hearing the case for nearly two years. Initially, he was part of the Bench presided by recently appointed Law Commission head, Justice BS Chauhan. After Justice Chauhan’s retirement, Chelameswar J. has been presiding over the Bench; in 2014, the apex court had granted bail to Maudany.
