Lalu Prasad Yadav likely to use bail on medical ground for political purpose, CBI tells Supreme Court

The Central Bureau of Investigation has filed an affidavit before the Supreme Court opposing the bail plea of Rashtriya Janata Dal (RJD) Supremo Lalu Prasad Yadav convicted in the fodder scam..Yadav who has been in a hospital for about eight months now had sought bail on medical grounds. However, the CBI has flagged the possibility of Yadav using the garb of medical grounds to secure a bail order and using his release for political purposes..The CBI has stated that Yadav had earlier sought bail from the High Court wherein one of the additional grounds stated for seeking the relief was the necessity of his presence in guiding his political party RJD in the lead up to the upcoming General Elections. This bail plea was rejected by the High Court..“The very same petitioner who wanted to get bail to lead his party in coming Lok Sabha election in elections comes before the highest court of the country in the present matter and again seeking bail on medical grounds”, the petition states..The CBI has also set out the details of Yadav’s conviction and his sentence and highlighted that Yadav has remained in the hospital ever since his conviction and has not served a single day in the prison. Yadav, in fact, carried out his political activities from the hospital ward, the CBI alleges..Pointing at Yadav’s attempt to secure bail by simultaneously on different grounds, the CBI has submitted that this should disentitle Yadav for grant of bail..“It is submitted that simultaneous raising of pleas for bail on medical grounds and bail to guide the party and to carry out all essential responsibilities as a party president in ensuing Lok Sabha election are mutually contradictory and manifests that in the garb of Bail on Medical Ground the Petitioner in essence want to pursue his political activities which is impermissible in law. Thus on this ground only the present petition is liable to be dismissed.”.Yadav is convicted in three cases pertaining to the fodder scam that took place in the 1990s in undivided Bihar.
