The Andhra Pradesh High Court had recently stayed the state government's move to trifurcate the State's capital while acting on a plea moved by a group of farmers.
After Chief Justice of India SA Bobde recused from hearing the case related to Andhra Pradesh's three-capital plan earlier this week, Justice Rohinton Nariman followed suit in recusing from the case today.
Today, the respondents in the case circulated a letter apprising the Court that they had briefed Justice Nariman's father, Senior Advocate Fali Nariman, in the case. Owing to this, Justice Rohinton Nariman recused himself from the case.
Justice Nariman was sitting with Justices Navin Sinha and Indira Banerjee.
Earlier this week, the matter was placed before a Bench headed by CJI SA Bobde, who recused himself after it was brought to the Court's notice that CJI Bobde's relative had represented one of the private parties in the case before the High Court.
The Andhra Pradesh High Court had recently passed an order staying the state government's move to trifurcate the State's capitals at Kurnool, Vishakhapatnam and Amaravati. This order was passed in a plea moved by a group of farmers.
The state government's move to set up Kurnool as the Judicial capital, Vishakhapatnam as the Executive capital, and Amaravati as the Legislative capital, had received the Governor's assent on July 31.
