Document leak in Anil Deshmukh case: Delhi Court declines further CBI custody of lawyer Anand Daga, SI Abhishek Tiwari

A Special CBI Court on Monday remanded Mumbai lawyer Anand Daga and sub-inspector Abhishek Tiwari to judicial custody in connection with an alleged documents leak case related to the ongoing probe against former Maharashtra Home Minister Anil Deshmukh [CBI v. Abhishek Tiwari & Anr]..Special Judge Vimal Kumar Yadav remanded Daga and Tiwari to 14 days of judicial custody after declining plea of Central Bureau of Investigation (CBI) which had sought the custody of the two accused for five more days..The Court noted that according to the CBI, though the data had been extracted, the analysis was ongoing along with the interrogation of the both the accused persons. The CBI further said that the data was voluminous, indicating the complicity of other persons. Upon inquiry, the CBI informed the Court that there were no further recovery and it was unlikely that there would be any further recovery to be done..Counsel appearing for both men submitted that there was no change in the circumstances and the CBI had reiterated its previous submissions made on September 4, 2021. It was also argued that the preliminary inquiry was in the public domain, which was reportedly circulated on social media..The counsel, therefore, submitted the CBI could always investigate and secure the presence of the accused persons in the investigation for which custody was not required.“Both the accused persons are in CBI custody. The recoveries from them have already been made,” the Court noted.The Court, however, said that on the last occasion the CBI had stated that the extraction of data would take much time and the data in question was recovered four days ago. “In these circumstances, when the accused persons have remained in CBI custody for four days, there appears no reason to further extend their CBI custody as nothing new showing the nature of data extracted and the confrontation of the same is before the Court.
