Article 21 encompasses right of non-refoulement: Manipur High Court orders safe passage for 7 Myanmarese nationals to UNHCR office in Delhi
Protections afforded by Article 21 of our Constitution would encompass the right of non-refoulement, provided that the presence of asylum seekers is not prejudicial to the country's security, the Court said.
The Manipur High Court has ruled that the protections under Article 21 (right to life and personal liberty) of the Indian Constitution would also include the right of non-refoulement for asylum seekers (Nandita Haksar v. State of Manipur and ors).
