A Mumbai court on Monday told the Narcotics Control Bureau (NCB) that the permission to interrogate Kiran P Gosavi panch witness in the cruise ship drug case, will have to be obtained from the relevant court in Pune since Gosavi is in judicial custody of Pune court. .Special Judge VV Patil, therefore, declined to grant relief to NCB instead asking the agency to approach the concerned Pune court. .Gosavi is presently in judicial custody in Yerwada prison as per order of a Magistrate in Pune in a case of alleged cheating where two persons were allegedly cheated by Gosavi promising jobs overseas. He is an independent witness in the drug case which was initiated by NCB after drugs were found on Cordelia Cruises' Empress ship, on which a rave party allegedly took place.Bollywood actor Shah Rukh Khan's son Aryan Khan is the prime accused in the case which also has 19 other co-accused. .NCB stated in its application that in order to file a chargesheet in the cruise ship case, it is necessary to record the statement of Gosavi under Section 67 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. "In order to have fair transparent investigation, it is necessary to record voluntary statement of said panch witness," NCB submitted.It, therefore, sought order from the Court to issue directions to the Jail Superintendent at Yerwada jail to permit the agency to "visit, examine, interrogate, record voluntary statement under Section 67"..The Special Public Prosecutor submitted that NCB Mumbai zonal unit was ready to go to Yerwada tomorrow by 12 pm and would need three days to interrogate Gosavi. .After hearing the prosecutor's submissions, judge Patil noted that Gosavi was in the judicial custody as per the orders of the judicial magistrate's court at Pune. Hence, the NCB would have to approach the concerned court for necessary permission, it was stated.With this observation, the Court disposed of the application.
