The Bombay High Court on Wednesday issued notice to the National Investigation Agency (NIA) on a plea filed by Telugu poet Varavara Rao, accused in Bhima Koregaon case of 2018, seeking permission to conduct his cataract surgery at Hyderabad..Justice RG Avachat directed the NIA to respond to the application filed by Rao seeking to quash the order of the special NIA court refusing him leave to go to Hyderabad for the surgery..Rao was arrested in 2018 and had been in judicial custody till March 2021 when he was granted temporary bail of 6 months on medical grounds by the Bombay High Court.The Supreme Court in August 2022 granted him bail on medical grounds. One of the conditions in the order was that Rao cannot leave the jurisdiction of the special NIA court in Mumbai. .After the Supreme Court order, Rao moved the special NIA court in Mumbai in September seeking permission to stay in Hyderabad for three months for the surgery. The application was rejected by the special court on September 23. Rao challenged that order in High Court through the present plea filed in November 2022 through advocate R Satynarayanan. .He pointed out that the special court failed to consider the grounds on which he was seeking permission:Surgery or medical treatment in Mumbai was expensive. In State of Telangana, Rao claimed, he was entitled to free medical services as he was a pension holder. Rao also clarified that the government hospitals in Mumbai are in abysmal condition which was also considered by a co-ordinate bench while granting him temporary bail. Arguments on his discharge application are still in progress and out of six discharge applications filed so far, arguments have concluded only in one. In view of this, there was a long way to go before the trial would even commence. He has never misused his liberty while he had been on medical bail since March 6, 2021.
