Police have not investigated properly: Plea in Bombay High Court to reinvestigate suicide of Anvay Naik

The Bombay High Court on Saturday sought the response of State of Maharashtra in a plea by Adnya Naik seeking re-investigation into the case of suicide of her father, interior designer Anvay Naik in which Republic TV Editor, Arnab Goswami was an accused. .Bench of Justices SS Shinde and MS Karnik issued notice to the State in the plea on Saturday when Naik sought her plea ought to be heard along with the plea filed by Goswami challenging his illegal arrest and detention in connection of Naik's death..Adnya in her plea has prayed for transfer the investigation in the abetment to suicide FIR (CR No. 59 of 2018) registered in connection with her father's suicide to the Crime Branch of Mumbai or any other independent agency alleging that police officers who initially probed the case botched up the investigation with the intention to help the accused persons. ."Police have not investigated the offence properly and have filed a false, fake, fabricated and botched up final report just with an intention to help the accused persons," Adnya has contended in her plea..She has also sought an inquiry against the investigation officers involved in the probe and imposition of appropriate punishment on them. .The 2018 case arose after Akshata Naik, Adnya's mother, registered an FIR against Arnab Goswami and two others, accusing them of abetting the suicide of Naik and his mother..The accused allegedly owed money to Naik's company, Concorde Designs Pvt. Ltd. (CDPL) which they did not repay leading to financial losses for the company prompting Naik and his mother to take the extreme step. .Advocate Subodh Desai appearing for Adnya Naik submitted on Saturday that Adnya and her mother had followed up the matter with the Raigad Police till as late as March 2020. However, she got information about the closure of the case through social media posts..It was also argued that they had received unsolicited calls threatening to settle the financial debts and also received suspicious threats after her mother's video was posted on her social media account..Desai added that her mother received the certified copy of the "A" Summary report and other relevant documents only in May 2020..It was also submitted that the Chief Judicial Magistrate did not allow the mandatory procedure under Code of Criminal Procedure (CrPC) of summoning the complainant, Adnya's mother when the "A" summary was filed seeking closure of the investigation..The investigation, it has been alleged, was biased and the final report was filed to facilitate and clear the path for the accused persons.."It is necessary to re-investigate the matter so to ascertain as to how the investigation carried out by the Investigating authority is arbitrary and not in accordance with law and was commenced and concluded so as to the benefit of the Accused and to the detriment of the justice system," the plea states..[Read order here]
