[COVID-19] "Lockdown" cannot be used as a magic wand to wish away every default: Madras High Court
"Courts have no authority to change the law. Lockdown is not a magic wand," Chief Justice Sanjib Banerjee orally observed during the hearing.
The Madras High Court on Monday emphasised that the COVID-19 lockdown cannot always be invoked as a "magic wand" to wish away every default, while disposing of a plea moved by a bidder who had failed to complete the payment for a property auctioned under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest (SARFAESI) Act, 2002 (K Kayalvizhi v. The Branch Manager).
