[COVID-19] Necessary to issue Guidelines for Safe Disposal of Face Masks: Kerala HC, State Government to file a Report

Meera Emmanuel

The Kerala High Court today emphasised that necessary guidelines must be issued for the safe disposal of N-95/face masks used to guard against the transmission of COVID-19, more so since face masks have now been made mandatory in public places amid the COVID-19 pandemic.

The Bench of Justices PV Asha and Shircy V, therefore, impleaded various Government authorities as parties to the suo motu PIL kept pending by the High Court to monitor issues that may crop up during the period of the COVID-19 crisis.

"While the functioning of the Health Department has been laudable all along … we think it is appropriate to issue necessary guidelines for the disposal of face masks since wearing of masks in public places has been made mandatory."
the High Court observed.

To this end, the Court today directed the arraignment of, inter alia, the State Health department, the Pollution Control Board, the State Disaster Management Authority, the Director of Urban Affairs and Panchayat authorities in the matter.

Appearing for the State of Kerala, Additional Advocate General Ranjith Thampan today said that instructions can be taken to appraise the Court on steps taken for the safe and scientific disposal of face masks in Kerala.

The Court has also recorded the State Government's undertaking to file a statement or a report on the issue when the matter is taken up next.
