[Delhi Riots UAPA case] Delhi Police opposes bail plea of Umar Khalid, says it will demonstrate 'prima facie' case

The Delhi Police has opposed the bail application filed by JNU scholar Umar Khalid in the Unlawful Activities (Prevention) Act (UAPA) case filed against him related to the Delhi Riots, stressing that it would demonstrate a “prima facie” case against him [Umar Khalid v. State]..The reply filed before Additional Sessions Judge Amitabh Rawat also pointed out that the present case pertained to “a larger conspiracy” that was registered on March 6, 2020. It said that of the 21 persons arrested in the case, the police chargesheeted 18 people, including Khalid.“Further investigation in terms of 173(8) Cr.PC is still in progress. The application filed by the applicant (Khalid) has no merit as would be revealed and demonstrated before this Court by reference to the chargesheet filed before this Court and as such the prosecution does not seek to file detailed reply to the present application,” the reply stated.The prosecution, in its reply, further stated that it would “demonstrate the ‘prima facie’ case against the applicant by reference to and relying upon the chargesheet filed before the Court"..The Police also referred to the the three Special Leave Petitions before the Supreme Court against the three judgments separately passed by the Delhi High Court granting bail to co-accused Devangana Kalita, Natasha Narwal and Asif Iqbal Tanha.The reply contended that the Supreme Court by an order on June 18, 2021 had stated, “In the meantime, the impugned judgment shall not be treated as a precedent and may not be relied upon by any of the parties in any of the proceedings.”It was, therefore, argued, “So, these judgments cannot be cited and relied upon by the applicant/accused in the instant case.
