Facilitation Council under MSMED Act can act as arbitrator despite bar u/s 80 of Arbitration Act: Supreme Court

A Bench headed by Chief Justice of India UU Lalit ruled that Chapter V of the MSMED Act would override the provisions of the Arbitration Act in this regard.

The Supreme Court on Monday held that no party to a dispute with regard to any amount due under Section 17 of the Micro, Small and Medium Enterprises Development Act, 2006 (MSMED Act) would be precluded from making a reference to the MSME Facilitation Council even in the presence of an independent arbitration agreement.
