Frivolous pleas must be treated with iron hands: Bombay HC imposes Rs 50 lakhs as costs

"It needs to be curbed and treated with iron hands, so as to deter the litigants from taking the Court for a ride by misusing the process", the High Court observed.

The Nagpur Bench of the Bombay High Court recently imposed Rs. 50 lakh fine on Nagarjuna Agro Chemicals Pvt Ltd, a fertilizer company for filing frivolous pleas with an ulterior motive of commercial gain and abuse of Court process.

The Division Bench of Justices Ravi K Deshpande and Milind N Jadhav passed an order to this effect, while reiterating such vexatious litigation ought to be curbed with iron hands.

... the Court has to be intolerant to such situation and the practice of filing such frivolous and vexatious litigation, without having any genuine interest and lacking in all bona fides. It needs to be curbed and treated with iron hands, so as to deter the litigants from taking the Court for a ride by misusing the process.
