Intimation of detention through SMS invalid, against Constitutional safeguards: Madras High Court
Justices M Sundar and Nirmal Kumar allowed a habeas corpus petition moved by the wife of a man detained under the Tamil Nadu Goondas Act.
The Madras High Court recently quashed the detention order passed by the local police against a man under the Tamil Nadu Goondas Act on the ground that the police had sent the arrest intimation to the detenue's wife only through the Short Message Service (SMS).
