The Bombay High Court granted time to Bollywood actress Kangana Ranaut to inform the Court if she was willing to apply for regularisation of her residential property which was declared to be unauthorised by the Brihanmumbai Municipal Corporation (BMC)..Justice PK Chavan also extended the interim protection granted to Ranaut by the Mumbai City Civil Court in its order dismissing her application in the suit challenging the BMC notice..Senior Advocate Birendra Saraf, appearing for Ranaut, informed the Court that protection ought to be granted to her as the unauthorised construction was due to the fault of the developer. The same was an issue for all other flat owners in that building as well, he pointed out. He also alleged that BMC was acting out of vendetta against Ranaut..After the Court asked him what was the possible solution to this problem, Saraf replied that regularisation seemed to be a solution..Senior Advocate Aspi Chinoy retorted that the notice under challenge in the suit was issued in 2018. He added that by asking for regularisation, there was an implication that the irregularities were admitted..At this point, the Court stated that it did not seem like a vendetta. "Where is the question of vendetta Mr. Saraf?" Justice Chavan asked..Saraf requested the Court to grant protection to Ranaut, so that he can take written instructions on whether she will apply for regularisation of the structure..He added that since the regularisation would affect the other residents of the apartment as well, they will have to be consulted, which will require some time. He requested the Court to keep the appeal pending while he takes instructions..After hearing both parties briefly, the Court granted time to Saraf till February 5 to get instructions from Ranaut..The interim protection granted by the Sessions Court against possible coercive action in lieu of the notice was also extended till then.
