The Karnataka High Court has directed the Registrar (Judicial), Registrar General and Registrar (Computers) to implement e-notarisation in filings before the Karnataka high Court and the District Court. .Justice Suraj Govindaraj directed the acceptance of e-notarisation while taking on record a compliance affidavit that was notarised electronically. The order was passed in a case relating to the restrictions imposed on a bank account pursuant to a cybercrime investigation. .Counsel for IIFL Finance Limited, Advocate Priyanka S Bhat, provided a detailed process on how the e-notarisation was obtained in a memorandum of facts filed before the Court. The authorised signatory and notary joined a live audio-video conference with the same affidavit displayed on their screen. The notary verified the signatory's identity and authority to act for the company, confirmed understanding of what was being signed, recorded voluntary participation and administered an oath that the signatory had verified the contents of the affidavit. The signatory then electronically signed using Aadhaar-based e-KYC. The notary then stamped with her official seal and electronically signed the affidavit. .Earlier this week, Justice Govindaraj told advocates moving matters before the cause list was taken up that papers could be scanned and shared with the Court.
