Myanmar terror training case: Delhi court allows accused US and Ukrainian nationals to travel to their home countries

A Delhi court on Thursday allowed a US national and six Ukrainians arrested in a terror case by the National Investigation Agency (NIA) to travel to their home countries for a month to meet their families.

Special NIA Judge Prashant Sharma of the Rouse Avenue Court passed the order after all seven persons were earlier granted default bail.

The bail was granted on September 18 by the Court after the NIA failed to complete its investigation on time and file a chargesheet under the Unlawful Activities Prevention Act (UAPA).

On Thursday, the Court passed further orders allowing them to return to their home countries.

US national Matthew Aaron VanDyke and six Ukrainian nationals -- Hurba Petro, Slyviak Taras, Ivan Sukmanovskyi, Stefankiv Marian, Honcharuk Maksim and Kaminskyi Viktor -- who were arrested by the NIA in March 2026.  

An FIR was registered against them under Section 18 of the UAPA, alleging a conspiracy to carry out terrorist activities. 

The group was accused of entering Mizoram state without valid permits and then illegally crossing into Myanmar, where they allegedly provided drone-warfare training to ethnic armed groups fighting Myanmar's military government. 

The case was initially registered under Section 18 of the UAPA, but in the first chargesheet filed in the case, the NIA only referred to violations of the provisions of the Immigration and Foreigners Act.

It later clarified that terror charges have not been dropped against the accused.

NIA was represented by Special Public Prosecutor (SPP) Rahul Tyagi, as well as advocates Ankit Gautam and Jatin.
