NCLT suspends functioning of Mumbai Bench's court VI due to vacancies

The tribunal has directed that all pending matters before Court VI be distributed among the five remaining courts of the Mumbai Bench.

The National Company Law Tribunal (NCLT) has ordered temporary suspension of functioning of court VI of its Mumbai Bench from October 13, citing vacancies in the posts of tribunal members.

In an administrative order dated October 9, the NCLT directed that all cases pending before court VI be transferred to the five other courts of the Mumbai Bench.

The suspension will remain in effect until further orders.

"In view of the vacancies to the post of Members at the National Company Law Tribunal, Mumbai Bench, the functioning of Court no. VI Mumbai Bench is temporarily suspended, w.e.f. 13.10.2026, until further order," the order stated.

The decision was taken with the approval of the NCLT President under Rule 16(d) of the National Company Law Tribunal Rules, 2016.

According to the order, pending matters have been divided among Courts I, II, III, IV and V of the Mumbai Bench.

The redistribution covers cases filed under Sections 7, 9, 10 and 95 of the Insolvency and Bankruptcy Code (IBC), 2016.

Cases filed under Section 7 of the IBC, which concerns insolvency proceedings initiated by financial creditors, have been divided into five groups based on their serial numbers in the annexure to the order.

Similarly, matters initiated by operational creditors under Section 9 have been distributed among the remaining five courts.

The tribunal has directed all concerned court officers to transfer and receive the relevant case records and list the matters on their next scheduled hearing dates in accordance with the last orders passed in those cases.

The administrative decision comes amid vacancies affecting the functioning of the tribunal's Mumbai Bench. However, the order does not specify the number of vacant posts or indicate when court VI is likely to resume functioning.
