A Special Court in Mumbai under the National Investigating Agency (NIA) Act today permitted ex-cop Sachin Waze to get treated at a private hospital. .Waze is lodged in Taloja Central Prison as prime accused in the case connected to an explosives-laden SUV found outside Reliance Industries Chairperson Mukesh Ambani’s residence and the death of businessman Mansukh Hiren..Waze had filed the present application seeking Court‘s intervention to permit him treatment for health issues due to blockage of crucial arteries in his heart. .Waze had earlier been taken to JJ hospital where the doctors asked him to get admitted immediately to undergo a bypass surgery. However, Waze refused admission at the government facility instead seeking permission to be admitted at a private hospital at Thane. .Advocate Sudip Pasbola appearing for Waze, referred to three medical reports which pointed out that Waze required medical intervention. The doctors purportedly stated that Waze could die if he is not given treatment. “Nothing is more important than the life of a person. The investigation will be futile if the person does not survive," Pasbola contended.."I don't want to become Stan Swamy," Waze submitted.Waze was referring to octogenarian Jesuit priest Father Stan Swamy who passed away last month in judicial custody. .[BREAKING] Bhima Koregaon accused Father Stan Swamy passes away .Special Judge PR Sitre allowed Waze’s application and permitted him to get treatment at a private hospital in Thane district. .NIA also filed an application seeking Waze’s custody for 2 days on the grounds that they found certain incriminating material against a “suspected person” who has a key role in the case. .NIA submitted that its investigation was in the final leg and without Waze’s custody, the agency will not be able to come to an ultimate conclusion. “Incriminating material has been found with those five persons who were arrested in June. March to August innumerable statements have been recorded and the accused need to be confronted with them. Mansukh Hiren was most important preplanned conspiracy. The suspected person also has a role," Special Prosecutor for NIA submitted..Pasbola questioned the timing of NIA plea for remand. He argued that such a prayer for police custody should be allowed only in extraordinary circumstances and no exceptional circumstances were made out in the present case.“Here it is the same story which is being repeated. ’Unearthing conspiracy’ is their favourite word and if they have not unearthed until now then help them God!” Pasbola submitted. ."No doubt the law provides for NIA to take remand of an accused, but there are other aspects,” Pasbola said, adding that NIA‘s grounds for seeking custody were vague. He argued that while NIA was entitled to remand at the initial stage of arrest, presently there was a delay which needed to be explained and which was not mentioned in the affidavit..After hearing the counsel in detail, the Special Court rejected NIA application seeking Waze’s custody.
